1. INTRODUCTION
These Terms and Conditions ("Terms") govern the relationship between Bush Key Tours Limited, operating as Bush Key Safaris ("we," "our," "us"), and the client ("you," "your") who books or participates in our safari tours, packages, and related services. By booking our services or using our website, you agree to be bound by these Terms.
Please read these Terms carefully before making a booking. If you do not agree to these Terms, please do not use our services.
2. BOOKING AND PAYMENT TERMS
2.1 Booking Process

All bookings must be made in writing, either through our website, email, or booking form.

A booking is confirmed only after receipt of the required deposit and our written confirmation.
-
By making a booking, you warrant that you have the authority to accept these Terms on behalf of all members of your party.
2.2 Deposit and Payment Schedule
-
A non-refundable deposit of 30% of the total tour price is required to secure your booking.
-
The balance payment is due 45 days prior to the safari commencement date.
-
For bookings made within 45 days of departure, full payment is required at the time of booking.
-
For last-minute bookings (within 14 days of departure), payment must be made by bank transfer or credit card.
2.3 Payment Methods
-
We accept payments by bank transfer, credit card, and other specified payment methods.
-
All payments must be made in the currency stated in your invoice.
-
You are responsible for any bank charges or transaction fees associated with your payment.
2.4 Price Guarantee and Adjustments
-
Once your booking is confirmed, the price of your safari is guaranteed, except for:
-
Government action or increases in national park fees
-
Significant currency fluctuations (exceeding 5%)
-
Changes to your itinerary requested by you
-

Any price adjustments will be communicated to you as soon as possible.
3. CANCELLATION AND CHANGES
3.1 Cancellation by Client
Cancellation must be submitted in writing. The following cancellation fees apply:

More than 60 days before departure: Forfeit of deposit (30%)
-
59-45 days before departure: 50% of total safari cost
-
44-30 days before departure: 75% of total safari cost
-
Less than 30 days before departure: 100% of total safari cost
3.2 Cancellation by Bush Key Safaris
We reserve the right to cancel a tour for any reason, including but not limited to:

Insufficient participants
-
Force majeure events
-
Safety concerns
In such cases, we will offer you:
-
Alternative travel arrangements of similar standard and value, or
-
Full refund of all monies paid
Bush Key Safaris is not liable for any incidental expenses incurred by you as a result of cancellation.
3.3 Changes to Bookings
3.3.1 Changes by Client
-
Changes requested by you are subject to availability and may incur additional costs.
-
A service fee of $50 USD applies to all changes made after confirmation.
-
Significant changes within 45 days of departure may be treated as a cancellation.
3.3.2 Changes by Bush Key Safaris
-
We reserve the right to alter routes, schedules, itineraries, and accommodations if necessary.
-
If significant changes are made, we will inform you as soon as reasonably possible.
-
If a significant change results in reduced value, appropriate compensation will be offered.
4. SAFARI OPERATIONS AND CONDUCT
4.1 Safari Participation
-
You must comply with all reasonable instructions of tour guides and staff.
-
We reserve the right to remove any client whose behavior is deemed dangerous, disruptive, or incompatible with the interests of the tour group.
-
No refund will be given if you are removed from a tour due to inappropriate behavior.
4.2 Health and Fitness
-
You must inform us at the time of booking of any medical conditions, disabilities, or special requirements.
-
You are responsible for ensuring you are fit to participate in your chosen safari activities.
-
We reserve the right to refuse to accept a booking if we have concerns about your health or fitness.
4.3 Documentation and Requirements
-
You are responsible for obtaining all necessary travel documentation, including valid passports, visas, and vaccination certificates.
-
Failure to possess required documentation may result in denied boarding or entry, and no refund will be provided.
-
We recommend comprehensive travel insurance covering medical emergencies, evacuation, and trip cancellation.
4.4 Safari Experience
-
Wildlife sightings cannot be guaranteed, and no refunds will be provided for lack of specific wildlife encounters.
-
Accommodations are as described in your itinerary but may be substituted with alternatives of similar standard if necessary.
-
We reserve the right to assign vehicles and guides as needed for operational efficiency.
5. LIABILITY AND INSURANCE
5.1 Limitation of Liability

Bush Key Safaris acts as an intermediary between you and service providers (hotels, transportation, activities).
-
We are not liable for any injury, damage, loss, accident, delay, or irregularity that may be caused by defect or default of any company or person engaged in providing services.
-
Our liability is limited to the maximum extent permitted by law and will not exceed the cost of the services provided.
5.2 Force Majeure
We are not liable for failure to perform our obligations if such failure is as a result of events beyond our reasonable control, including but not limited to:

War or threat of war
-
Acts of terrorism
-
Natural disasters or adverse weather conditions
-
Fire or industrial disputes
-
Technical problems with transportation
-
Epidemics or pandemics
-
Government regulations or actions
5.3 Travel Insurance
-
Comprehensive travel insurance is mandatory for all clients.
-
Your insurance must cover medical emergencies, evacuation, personal liability, cancellation, curtailment, and loss of luggage and personal effects.
-
Proof of insurance must be provided prior to safari commencement.
6. PASSPORTS, VISAS, AND HEALTH REQUIREMENTS
6.1 Passports and Visas
-
All clients must possess a valid passport with at least six months validity beyond the intended date of departure from Tanzania.
-
You are responsible for obtaining all necessary visas and entry permits.
-
We can provide general visa information but cannot be held responsible for any visa application issues.
6.2 Health Requirements
-
You are responsible for complying with health requirements and obtaining recommended vaccinations.
-
We recommend consulting with a travel doctor well in advance of your safari.
-
If you have any medical conditions that may affect your safari, you must inform us at the time of booking.
7. WILDLIFE VIEWING AND SAFARI ACTIVITIES
7.1 Wildlife Interactions
-
All wildlife viewing is conducted according to national park rules and regulations.
-
Clients must maintain a safe distance from all wildlife and follow guide instructions at all times.
-
Feeding, touching, or harassing wildlife is strictly prohibited.
7.2 Safari Vehicles
-
Our vehicles are regularly maintained and equipped for safari conditions.
-
Maximum passenger numbers per vehicle will not be exceeded.
-
Seat rotation may be implemented on multi-day safaris.
-
Smoking is prohibited in safari vehicles at all times.
7.3 Activities and Excursions
-
Optional activities not included in the tour package are undertaken at your own risk.
-
We may subcontract certain activities to reputable third-party providers.
-
All activities are subject to weather conditions and local circumstances.
8. PHOTOGRAPHY AND PRIVACY
8.1 Client Photography
-
Photography for personal use is encouraged but must comply with park regulations.
-
Commercial photography may require special permits, which are your responsibility to obtain.
-
Permission should be obtained before photographing local people.
8.2 Company Photography
-
We reserve the right to take photographs or videos during the safari for promotional purposes.
-
By participating in our safaris, you consent to such use unless you explicitly notify us otherwise in writing.
-
We will respect your privacy and dignity in all promotional materials.
9. COMPLAINTS AND DISPUTE RESOLUTION
9.1 During Your Safari
-
Any issues arising during your safari should be reported immediately to your guide or our local representative.
-
We will make reasonable efforts to resolve problems promptly.
9.2 After Your Safari
-
If you remain dissatisfied, complaints must be submitted in writing within 28 days of the end of your safari.
-
We will acknowledge receipt within 14 days and aim to provide a full response within 28 days.
9.3 Dispute Resolution
-
Any dispute arising from these Terms shall be governed by the laws of Tanzania.
-
Both parties agree to attempt to resolve any disputes amicably.
-
If amicable resolution is not possible, disputes shall be settled through arbitration in Tanzania.
10. GENERAL PROVISIONS
10.1 Entire Agreement
These Terms, together with the specific details of your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Bush Key Safaris.
10.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.3 Waiver
The failure of Bush Key Safaris to enforce any provision of these Terms shall not be construed as a waiver of such provision or the right to enforce it in the future.
10.4 Amendments
We reserve the right to update or modify these Terms at any time. The current version will be posted on our website with the effective date.
10.5 Third-Party Rights
No third party shall have any right to enforce any of these Terms.
11. SUSTAINABLE TOURISM COMMITMENT
11.1 Environmental Responsibility

We are committed to minimizing the environmental impact of our operations.

Clients are expected to respect wildlife, natural habitats, and local customs.

Please follow "leave no trace" principles during all safari activities.
11.2 Community Engagement

We actively support local communities through employment and community projects.

A portion of our profits is dedicated to conservation and community development initiatives.

We encourage respectful interaction with local communities.
